The main purpose of the right to protect personal data is to protect the privacy rights of individuals and enable the free circulation of personal data within the established legal framework.
Law on Personal Data Protection is based on several basic principles that guarantee legality, fairness and transparency in processing, limitation of the purpose of processing, accuracy, limitation of the duration of storage, ensuring integrity and confidentiality and the responsibility of those who process personal data.
The legal framework for the protection of personal data is initially regulated by the General Data Protection Regulation (GDPR), which came into force in May 2018, drafted by the European Union to strengthen and unify the protection of personal data for all individuals in the European Union and the European Economic Area (EEA), and founded on several key principles that focus on the privacy and security of personal data.
Incorporating transparency requirements into data processing, empowering data subjects with rights to their information, establishing clear consent protocols and introducing strict standards for personal data security and data breach notification are just some of its basic aspects.
Due to the stated need to comply with the General Data Protection Regulation (GDPR) standards, which came into force in May 2018, drafted by the European Union, the Republic of North Macedonia took important steps towards harmonizing its national legislation with the GDPR and adopted the Law on Personal Data Protection, published in the "Official Gazette of the Republic of North Macedonia" no. 42/20, drafted in a way that incorporates the basic principles and requirements of the GDPR, including accountability, transparency and the rights of individuals over their personal data.
